Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the danartlabs.com website (the "Service") operated by Dan Art Labs ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you do not have permission to access the Service.

On-Demand Printing: Refers to the process where products are custom-printed and fulfilled by a third-party print provider (Dan Art Labs) only after an order is placed.

2. Products and Services

Nature of Products: All products offered by Dan Art Labs are created on an on-demand basis. This means that each item is custom-printed specifically for your order through our fulfillment partner, Dan Art Labs, and we do not hold pre-made inventory.

Product Descriptions: We strive to ensure that all product descriptions, images, and pricing information on the Service are accurate and up-to-date. However, we do not warrant that product descriptions or other content of this Service is entirely accurate, complete, reliable, current, or error-free. Colors may vary slightly due to monitor settings and the nature of the printing process.

Pricing: All prices are listed in USD and are subject to change without prior notice. Applicable taxes and shipping fees will be added at checkout.

Availability: Products are subject to availability. In the rare event that an item you ordered becomes unavailable after your purchase, we will notify you and offer a refund or an alternative.

3. Orders and Payment

Order Acceptance: Your placement of an order does not necessarily assure our acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product description, or issues identified by our fraud prevention team. If we cancel an order after you have been charged, we will issue a full refund.

Payment: We accept various payment methods as indicated on our checkout page. By submitting your payment information, you represent and warrant that you are authorized to use the designated payment method and authorize us (or our third-party payment processor) to charge your payment method for the total amount of your order.

Order Confirmation: Upon successful payment, you will receive an order confirmation email. This email serves as an acknowledgment of your order and does not constitute acceptance of the order.

Cancellations: Due to the on-demand nature of our products, orders enter production very quickly. Therefore, we generally cannot accept order cancellations once an order has been placed. 4. Shipping and Delivery

Shipping Provider: All products are shipped directly from our fulfillment partner by Dan Art Labs.

Shipping Times: Estimated shipping times are provided at checkout and are based on information from Dan Art Labs and shipping carriers. These are estimates only and are not guaranteed. Actual delivery times may vary due to factors beyond our control (e.g., customs delays, peak seasons, adverse weather).

Risk of Loss: The risk of loss for purchased items passes to you upon our delivery to the carrier.

International Shipping: We may offer international shipping to select countries. Please note that international orders may be subject to customs duties, taxes, and fees levied by the destination country. These charges are the sole responsibility of the recipient.

5. Returns and Refunds

Summary: Due to the custom, on-demand nature of our products, we generally do not accept returns or offer refunds for buyer's remorse, accidental orders, or changes of mind. We will, however, gladly replace items that are damaged, defective, or incorrect upon arrival, provided you notify us within the specified timeframe and provide necessary photographic evidence as outlined in our Return Policy.

6. Intellectual Property

Our Content: All content on the Service, including but not limited to text, graphics, logos, images, digital downloads, and the compilation thereof, is the property of Dan Art Labs or its content suppliers and protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as generally permitted by the Service.

Your Content (if applicable): If the Service allows you to upload or submit your own content (e.g., custom designs), you retain all rights to your content. However, by submitting content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content solely for the purpose of fulfilling your order or providing the Service. You warrant that your content does not infringe upon the intellectual property rights of any third party.

7. User Conduct

By using the Service, you agree not to:

Dan Art Labs makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials, or products included on this Service. You expressly agree that your use of the Service is at your sole risk.

9. Limitation of Liability

In no event shall Dan Art Labs, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

10. Indemnification

You agree to defend, indemnify, and hold harmless Dan Art Labs and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

12. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

Any dispute arising from or relating to the subject matter of these Terms shall be subject to the exclusive jurisdiction of the courts located in Sri Lanka.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
